What is the doctrine of forum prorogatum?

  • Usually arises where one party files an application with the ICJ unilaterally inviting another state to accept jurisdiction with regard to the particular dispute where jurisdiction would not otherwise exist with regard to the matter at issue
  • If the other accedes to this, then the Court will have jurisdiction
  • First addressed by the ICJ in the Corfu Channel case (1949)
